1. Acceptance of Terms

By accessing or using GameHub ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use our services.

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance. We will notify users of material changes via email or a prominent notice on our website.

2. Eligibility

  • Exploit, cheat, hack, or manipulate games or leaderboard systems.
  • Upload or transmit viruses, malware, or malicious code.
  • Violate any applicable local, state, national, or international law.

5. Intellectual Property

All content on GameHub — including but not limited to text, graphics, logos, code, game assets, and the platform interface — is owned by or licensed to GameHub and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent.

Game names, characters, and associated assets belong to their respective game developers and publishers.

6. User-Generated Content

You retain ownership of any content you submit to GameHub (reviews, comments, suggestions). However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our services.

We reserve the right to remove any user-generated content at our sole discretion.

7. Third-Party Games and Content

GameHub hosts games and content from third-party developers. We do not endorse, warrant, or assume responsibility for the accuracy, reliability, or quality of third-party content. Any transactions, interactions, or disputes with third-party providers are between you and the provider.

8. Disclaimer of Warranties

GameHub is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose.
  • Warranties that our services will be uninterrupted, error-free, or secure.
  • Warranties regarding the accuracy or reliability of any content.

9. Limitation of Liability

To the maximum extent permitted by law, GameHub, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, use, or goodwill — arising from:

  • Your use or inability to use the Platform.
  • Any unauthorized access to or use of our servers or data.
  • Any errors, bugs, viruses, or harmful code on the Platform.
  • Any third-party content or conduct on the Platform.

Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless GameHub and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform.
  • Your violation of these Terms or any applicable law.
  • Your user-generated content.
  • Your infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to GameHub at any time, without prior notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitations of liability) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of San Francisco County, California.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and GameHub regarding your use of the Platform and supersede all prior agreements and understandings.
